Terms of Use

1. Provider and agreement

LookTrace is provided by magiclabs GmbH (“magiclabs”, “we”, “us”). Our full company details and dispute-resolution statement are in the Imprint. By downloading or using LookTrace, you agree to these terms and Apple’s Standard EULA. If there is a conflict about the app license, Apple’s Standard EULA controls; these terms control the LookTrace service to the extent permitted by law.

2. What LookTrace does

LookTrace analyzes garment regions from an outfit photo and returns visual product-search results. It may suggest clothing regions, categories, match labels, a complete-look total, and merchant links. The service uses automated visual-search providers and product information from third parties.

“Exact” and “Similar”, confidence, availability, and other labels are estimates based on available evidence. They are not authentication, appraisal, endorsement, or a guarantee that an item is identical.

3. Your photos and permissions

You retain your rights in photos you use. You grant us and our processors a limited, non-exclusive, worldwide right to process garment crops and search settings only as needed to provide, secure, and troubleshoot the search you request.

You must have the right to use the photo and must respect the privacy, publicity, copyright, and other rights of anyone shown. Do not use LookTrace to identify, monitor, harass, or infer sensitive traits about a person. When practical, use your own images or obtain permission from the person depicted.

4. Search results and merchants

LookTrace is a discovery tool. Merchants are independent third parties. Prices, taxes, currency, size, color, shipping, returns, authenticity, product descriptions, and stock can be incomplete, delayed, or change after a search. Verify all important information on the merchant’s site before purchasing.

Any purchase is between you and the merchant, under the merchant’s terms and privacy policy. magiclabs is not the seller, payment processor, fulfillment provider, or returns handler for merchant products.

5. Free use, subscriptions, and guest passes

The app may include limited free searches, promotional access, or guest passes. Their availability, amount, eligibility, and limits may change for future use; earned access already granted will be handled as shown in the app and required by law.

LookTrace Pro is offered as an auto-renewable subscription through Apple. The price, billing period, trial or offer eligibility, taxes, and renewal terms displayed in the App Store purchase sheet before confirmation control your purchase. Payment is charged by Apple. Subscriptions renew automatically until cancelled. You can manage or cancel a subscription in your Apple Account settings. Deleting the app or a LookTrace account does not cancel an Apple subscription.

Use “Restore Purchases” in the app to restore eligible access. Refund requests are handled under Apple’s rules and mandatory law. We do not receive your full payment-card details.

6. Optional accounts

You can use core parts of LookTrace without an account. An account enables features such as cloud-synced saved looks and may enable referrals. You are responsible for protecting access to your Apple account and device. You must provide accurate information and promptly notify hello@magiclabs.dev if you suspect unauthorized account use.

7. Acceptable use

You may not:

• use LookTrace unlawfully or infringe intellectual property, privacy, publicity, or other rights;
• upload unlawful, exploitative, intimate, or sexual content involving any person without lawful authority, or any sexual content involving minors;
• use the service for facial recognition, person identification, surveillance, stalking, discrimination, or inference of sensitive traits;
• circumvent usage, subscription, security, or rate limits; automate abusive requests; scrape results at scale; or interfere with the service;
• reverse engineer or attempt to extract source code except where applicable law expressly permits it;
• misrepresent search results as verified authenticity or guaranteed product identity.

8. LookTrace intellectual property

LookTrace, its software, branding, interface, and original content are owned by magiclabs or its licensors. Subject to these terms and Apple’s Standard EULA, you receive a personal, limited, non-transferable, non-exclusive license to use the app on Apple-branded products you own or control as permitted by Apple’s Usage Rules. No other rights are granted.

9. Affiliate links and sponsored placements

Some merchant links may be affiliate links, meaning magiclabs could receive a commission if you purchase after following a link. LookTrace may also display paid placements or sponsored collections. Active commercial content will be clearly identified, including the brand, retailer, or other party on whose behalf it appears where required.

A commission or sponsorship does not change the evidence behind an “Exact” or “Similar” label and does not constitute authentication or a guarantee of the best price. Always verify merchant and product information before purchasing.

10. Availability and changes

Visual search depends on networks, providers, merchant pages, and regional availability. We do not promise uninterrupted access or a match for every image. We may add, change, suspend, or discontinue features for legitimate operational, security, legal, or product reasons. If a change materially affects a paid service, we will provide notice or remedies as required by law.

11. Suspension and termination

You may stop using LookTrace at any time and may delete an optional account in the app. We may restrict or suspend access where reasonably necessary to address fraud, abuse, security risk, legal requirements, provider restrictions, or a material breach of these terms. Where appropriate, we will give notice and an opportunity to remedy the issue.

12. Warranties

We provide LookTrace with the care required by applicable law. Visual matches and third-party data can be inaccurate or unavailable. To the maximum extent permitted by law, we do not give additional guarantees about uninterrupted availability, merchant products, or the identity, authenticity, fitness, or availability of a result. Statutory conformity rights and other mandatory consumer warranties are not excluded.

13. Liability

We are liable without limitation for intent and gross negligence; injury to life, body, or health; liability under the German Product Liability Act; guarantees expressly assumed; and any other liability that cannot legally be limited.

For slight negligence, we are liable only for breach of an essential contractual duty whose fulfillment makes proper performance possible and on which you may normally rely. In that case, liability is limited to the typical, foreseeable damage. These limitations also apply to our representatives and agents. Mandatory consumer rights remain unaffected.

14. Apple-specific terms

You and magiclabs acknowledge that these terms are between you and magiclabs, not Apple. magiclabs, not Apple, is responsible for LookTrace and for addressing support, product, legal, privacy, and intellectual-property claims concerning it, subject to applicable law and Apple’s Standard EULA. Apple has no obligation to provide maintenance or support for LookTrace.

Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce the Apple-specific provisions after you accept them. You must comply with applicable third-party terms, including your mobile-data agreement. You represent that you are not located in a country under a U.S. government embargo or designated as supporting terrorism and are not on a U.S. government prohibited or restricted-party list.

15. Governing law and consumers

German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. If you are a consumer, this choice does not deprive you of mandatory protections of the country where you usually live, and you may bring claims in any court available under mandatory law. Otherwise, where legally permitted, the courts at our registered office have jurisdiction.

16. Changes and severability

We may update these terms for future use when the service, providers, business model, or legal requirements change. We will provide reasonable notice of material changes where required. If a provision is unenforceable, the remaining provisions continue to apply; the invalid provision is replaced only as allowed by applicable law.
